Public offer

This document is a public offer of Gippokrat MFC LLP (hereinafter the “Seller”) and contains all the material terms of the retail sale contract concluded by remote means through the gippokrat.kz online store.

Any action by the Buyer to place an order (clicking “Add to cart”, “Place the order” or similar buttons) constitutes full and unconditional acceptance of this offer in accordance with Article 396 of the Civil Code of the Republic of Kazakhstan.

1. Terms and definitions

Seller — Gippokrat MFC LLP, BIN 060440000708, registered address: 010000, Astana, 46 Respubliki Ave., state licence for pharmaceutical activity No. FD65800300DZ of 05.04.2010.

Buyer — any legally capable individual who has accepted this offer.

Goods — medicines, medical devices, cosmetics and other pharmacy products presented on the Site.

Site — the online store at gippokrat.kz and its mobile applications.

Order — the Goods selected by the Buyer and submitted through the Site's cart.

2. Subject of the contract

The Seller undertakes to hand over Goods of proper quality to the Buyer, and the Buyer undertakes to accept and pay for them on the terms of this offer.

The Goods are handed over in one of two ways: pickup at a pharmacy of the chain or delivery by courier to the Buyer's address (where the service is available in the chosen city).

3. Placing an order

3.1. An order is placed on the Site by adding Goods to the cart and filling in the checkout form. To confirm their identity, the Buyer enters a phone number and a one-time code (OTP).

3.2. After the order is confirmed, the Buyer receives a notification with the order number and its preliminary contents. The final contents and price are formed once the Goods have been reserved at the pharmacy warehouse.

3.3. The Seller may cancel an order if the Goods are out of stock, notifying the Buyer on the phone number provided.

3.4. Prescription medicines are dispensed solely on presentation of the original prescription issued by a doctor.

4. Prices and payment

4.1. Prices for Goods are stated in tenge (₸) including VAT. The current price is shown on the Goods page at the time the order is placed.

4.2. Payment is made by one of the available methods:

• by Visa / MasterCard / MIR bank card online;
• through the Kaspi Pay payment service;
• in cash or by card on collection (only for orders paid on receipt, where the option is available).

4.3. The Seller may change prices without prior notice. A price change after the offer has been accepted is not permitted.

5. Delivery and pickup

5.1. Pickup. The average assembly time is 47 minutes from confirmation of payment. The Buyer receives an SMS/push notification when the order is ready. A ready order is kept at the pharmacy for 24 hours.

5.2. Delivery. The delivery time and cost are stated when the order is placed. Delivery is free for orders above the threshold shown on the Site.

5.3. On receiving the Goods, the Buyer must check that the contents match the order and that the packaging is intact. Claims about visible discrepancies are accepted only before the Goods are handed over.

6. Returns and exchanges

6.1. Returns and exchanges of medicines of proper quality are not permitted, in accordance with Resolution of the Government of the RK No. 394 of 15.03.1999 (List of goods that cannot be returned).

6.2. Goods of improper quality (defective, expired, not matching the order) may be returned within 14 days of receipt. To arrange a return, visit a pharmacy with the receipt or the order number.

6.3. Money for returned Goods is refunded to the Buyer's card within 10 business days.

7. Liability of the parties

7.1. The Seller is not liable for improper use of the Goods by the Buyer without consulting a doctor or pharmacist.

7.2. The Seller is not liable for delivery delays caused by third parties (the courier service, force majeure).

7.3. In the event of a breach of the terms of the offer, the Parties bear liability in accordance with the legislation of the Republic of Kazakhstan.

8. Personal data

By placing an order, the Buyer consents to the processing of their personal data in accordance with the Seller's Privacy Policy and Law of the RK “On personal data and its protection” No. 94-V of 21.05.2013.

9. Dispute resolution

9.1. Claims are sent to the e-mail address info@gippokrat.kz or made in person at any pharmacy of the chain.

9.2. Claims are reviewed within 10 business days.

9.3. If no agreement is reached, the dispute is referred to the court at the Seller's location (Astana) in accordance with the legislation of the RK.

10. Final provisions

10.1. The Seller may change the terms of this offer by publishing a new version on the Site. Changes take effect from the moment of publication.

10.2. Continued use of the Site after such changes constitutes the Buyer's agreement with the new version.
